Description

We will address the following issues:

  • Patient consent, including the requirements and standards for effective informed consent; determining a patient’s capacity or competency to give effective consent; minors’ ability to give consent; authorized surrogate decisionmakers may give consent for incompetent patients; telehealth consent; and suggestions for documenting informed consent
  • Patient confidentiality, including state and federal confidentiality requirements; penalties for a breach of confidentiality; exceptions that allow disclosure of patient information; statutes requiring breach reporting; responding to and reporting to breaches of confidentiality; and patient rights to information, including the right to access information
  • The new federal No Surprise Billing Rules, including to who it applies; how it applies to most healthcare providers; recent guidance; and penalties for noncompliance
  • The new Information Blocking Rule, including entities to which it applies; requirements for compliance; recent guidance; and penalties for noncompliance
  • Boundaries with guardian ad litem, including process and authority of guardian ad litem; disclosures and interactions with guardians; and suggestions for interactions with guardians
